In exchange, you must give up your nonexempt property or its equivalent in cash or other property. for a discussion on exempt property. In a Chapter 13 bankruptcy, you set up a court approved plan to repay your debts. Under the plan, you make monthly payments to the bankruptcy court—usually for three years. The court in turn pays your creditors a percentage of the money they are owed. Under the plan, you must use all of your disposable income to pay off your debts. In addition, your creditors must receive at least as much as they would have received had you filed for Chapter 7 bankruptcy—that is, the value of your nonexempt property. Some creditors, however—such as a former spouse to whom you owe alimony —are entitled to receive 100% of what you owe. (You can either pay it in full through your plan or come out of bankruptcy still owing some.) In Chapter 13 bankruptcy, you are not required to give up any property. If you’re deeply in debt, bankruptcy may seem like a magic wand. It often is. But it has its drawbacks too. First, it’s intrusive. A court-appointed person, the bankruptcy trustee, must approve almost all financial transactions you make while your bankruptcy case is open. For a Chapter 7 bankruptcy, this period can last several months. For a Chapter 13 bankruptcy, it can be as long as five years. Second, bankruptcy can cause practical problems, especially if you must surrender property you desperately want to keep. Finally, bankruptcy can be depressing some people would rather struggle along under mountains of debt than be labeled bankrupt. You may also be concerned about your credit rating. Credit bureaus can report bankruptcies on your credit record for ten years. But you can take steps to start rebuilding your credit almost immediately. (See Chapter 18 to learn how to do this.) And you’d be surprised at how quickly new credit cards will come in the mail after your bankruptcy. Some credit card companies are more than willing to extend credit to people who have recently completed a bankruptcy—they assume that given your track record, you’re likely to carry a balance on the card (which means more money for them in the form of interest) and won’t be able to discharge any debt for another six years (see Section A.1.). It will take longer to qualify for other types of credit, like mortgages or car loans.
